Please note that when accepting these terms you are to be bound by the following:
- Content. The (i) content made available on or through Altair development portal on Sony's Developer World (https://developer.sony.com/develop/cellular-iot) (“Site”) by Sony Semiconductor Israel Ltd. (“Sony”) , including without limitation, the text, documents, articles, brochures, descriptions, products, software, graphics, photos, sounds, videos, interactive features, and services (collectively, the “Content”), (ii) the trademarks, service marks and logos contained therein, are the property of Sony, its affiliates, its licensors and/or other third parties and may be protected by applicable copyright or other intellectual property laws and treaties. Sony and/or respective owners reserve all rights not expressly granted in and to the Site and the Content.
- Use of Content. Content on the Site is provided to you for your information and personal use only and may not be used, modified, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, reverse engineered, disassembled or otherwise exploited for any other purposes whatsoever without our prior written consent. If you download or print a copy of the Content you must retain all copyright and other proprietary notices contained therein.
- Confidentiality. You acknowledge that, you may be exposed to certain information concerning Sony, Sony’s customers, Sony’s products, services and related documentation, that is Sony’s confidential and proprietary information and that is not generally known to the public (”Confidential Information”). For the purpose herein, any Content shall be considered as Sony’s Confidential Information. You agree that you will take all appropriate steps to protect such Confidential Information from unauthorized disclosure, that you will not disclose such Confidential Information to any third party, and that you will not use any Confidential Information (other than as authorized by these terms) without the prior written consent of Sony. Your obligations with respect to Confidential Information shall continue for a period of five (5) years from the date of termination of these terms, or until such Confidential Information becomes publicly known, other than by breach of these terms by you. Without derogating from any other remedies available under applicable law or agreement, Sony shall be entitled to obtain an injunction restraining any violation, further violation or threatened violation of the covenant set forth herein.
- Limitation of Liability. Except to the extent prohibited by applicable law, in no event shall Sony be liable for any loss of income, business opportunity, anticipated savings, profits, goodwill, reputation or data, nor for special, the cost of procuring any substitute goods or services, direct, indirect, incidental, punitive or consequential damages, incurred or suffered by you, that arise under these terms or that otherwise result from the use of, or the inability to use, the content, even if Sony has been advised of the possibility of such damages. Sony’s total aggregate liability for all claims, damages, costs and losses arising under these terms, or in connection with the use of or inability to use the content, shall not under any circumstance exceed the amount of USD 100.
